We are often asked, “What can Dwyer Williams Potter, Attorneys do for me?” While this is a difficult question to answer, as each case’s value depends on numerous variables within that case, what we can say is that we are quite successful in the cases we handle. What follows is just a sample of some of our recent case results. Please note that only the clients’ initials are used so as to protect their identity.


S. P.: Client and his son stopped on Highway 97, waiting to turn left. Commercial tanker hits them from the rear, shooting them into an oncoming truck. Client sustained massive injuries, including fractures of the skull, neck, arms, hand, legs, and ankle, requiring multiple surgeries. Client also blind in one eye and sustained a brain injury. Client’s son also sustained extensive injuries. Liability denied – no offer. Settled for $2,000,000 at mediation.

R. S.: Client riding his bicycle when an uninsured driver runs him down from behind at highway speed. Massive injuries, including a back fracture, pelvic fractures, knee injuries and a shoulder injury, requiring multiple knee surgeries and a shoulder surgery. Liability denied, but offered $130,000. Arbitrator awarded $464,000.

M. M.: Client using a piece of equipment at a gym. The gym had removed a safety bar, and client fell off of the machine as a result. Client sustained a severe head injury, including memory difficulties, loss of taste, loss of smell, and loss of hearing in an ear. Liability denied – no offer. Settled for $400,000 shortly before trial.

R. P.: Client’s vehicle hit head on by uninsured motorist. The client suffered herniated discs in his lumbar spine requiring multiple surgeries. The client’s injuries left him permanently disabled. No settlement offers were made by insurance company despite numerous promises. We arbitrated the case and were awarded over $400,000.

R. N.: Client was a passenger in a single vehicle rollover accident. Multiple pelvis fractures. No prior offer. $345,000 settlement.

S. M.: Client unloading a large beam when homeowner suddenly grabs one end, slides it off the truck, and lets it drop to the ground. Client sustained injuries to his wrist and shoulder, requiring surgeries on each. Liability denied – no offer. Jury awarded $314,000 at trial.

J. M.: Client riding his bicycle to work just before dawn. An uninsured driver approached from behind, running him down. Client sustained massive orthopedic injuries, including several fractures of the spine and pelvis, requiring surgery. Liability denied – no offer. Arbitrator awarded $238,000.

R. M.: Client was wheelchair bound and when exiting a handicap van at the direction of the driver, her wheelchair flipped forward throwing her to the ground because the ramp was not level with the van. Fracture of the leg and shoulder. Liability denied – no offer. $230,000 settlement.

G. N.: Client using a port-o-potty on the job when another subcontractor ran into it, knocking it over. Among the client’s injuries were a C4-C5 and C5-C6 disk protrusions, requiring a fusion. Settled for $195,000.

J. J.: Client a passenger on an airliner when a bag fell from an overhead bin on takeoff, hitting him on the head. Client suffered neck and shoulder injuries, requiring multiple surgeries. Liability denied – no offer. Settled for $165,100 at mediation.

D. S.: Client operating a forklift loading the back end of a semi when the truck pulled forward, causing him to fall to the ground. Client suffered neck injuries, requiring a cervical fusion. Liability denied – no offer. Settled for $150,000 at mediation.

T. R.: Client riding his motorcycle when he was cut off by a car. Client slid under the car and ran over. The client’s injuries included lacerated liver, multiple broken ribs, punctured right lung, multiple breaks of pelvis, bruises, road rash, laceration over left eyebrow. Settled for $150,000 policy limits.

M. J.: Client was a passenger in a single vehicle rollover accident. Compression fractures at T12 and L3. No prior offer. $145,000 settlement.

P. N.: Client was a driver of an empty log truck that was involved in a head-on collision when a pick-up crossed the centerline on a curve. Client suffered a knee injury requiring surgery. Liability denied – no offer. $140,000 settlement at mediation.

L. T.: Client in shopping in a store when an improperly secured decoration fell from the ceiling, striking client on the head and knocking her out. Client’s injuries included severe neck problems requiring C3-4, C4-5 disketomy as well as severe headaches. Settled for $125,000.

V. B.: Client a passenger on a motorcycle who was thrown off due to the negligence of another motorist. Her injuries included multiple broken bones. The case settled for $125,000.

E. E.: Client fell because of a defect in a parking lot fracturing her elbow, and requiring elbow replacement surgery. Liability denied – no offer. $115,000 settlement at mediation.

T. B.: Client was a semi-truck driver who was run off the road by another vehicle, which caused his truck to roll. Partial rotator cuff tear and closed head injury. Liability denied – no offer. $112,500 settlement.

M. H.: While cutting tree limbs, client was jerked out of tree, rupturing his spleen. After hiring us, policy limits of $101,000 quickly obtained.

D. G.: 16 year old client was target shooting in friend’s back yard. Friend accidently shot client in shoulder, requiring surgery. Liability denied – no offer. Settled for $100,000 policy limit.

J. H.: Client was a passenger in a vehicle whose driver crossed the centerline causing a head-on collision. Client had a fractured wrist requiring several surgeries. No prior offer. Settled for $100,000 policy limit.

B. N.: Client walked past a pickup when a large dog lunged at her causing her to fall. Sustained a fractured right elbow and L2 compression fracture. Liability denied – no offer. Settled for $100,000 policy limit.

C. H.: Client involved in a car accident, causing a deep avulsion injury to left arm, and resulting in permanent scarring and muscle/nerve damage. No prior offer. $100,000 total settlement ($25,000 adverse policy limit and $75,000 UIM policy limit).

D. M.: Client was rear ended by another vehicle. Disk herniation at L2/3 requiring surgery. No prior offer. Settled for $100,000 policy limit.

C. A.: Client a passenger in a car when a truck pulls out directly in front of them, causing a wreck. Client suffered a severe exacerbation of underlying low back condition and low back nerve injury, requiring a low back fusion. Liability accepted, but refused to make an offer prior to retaining our firm. Settled for $100,000 policy limits.

C. H.: Client a passenger on a motorcycle. Uninsured motorist driving a car in front stops suddenly, causing the operator of the motorcycle to lose control and slide into the car. Client’s primary injuries included pelvic and elbow fractures, a herniated lumbar disk, and spleen damage that required surgery. Liability denied – no offer. Settled for $100,000 policy limits.

D. T.: Client using a table saw at school. The saw had its guard removed by the school staff. As the teacher watched the client operate the saw, the saw suddenly kicked back, nearly cutting off client’s finger and thumb. Multiple surgeries required. Liability denied – no offer. Settled for $100,000 at settlement conference.

V. S.: Client walking in fairgrounds parking lot when driver of truck cut his trailer too close, running her over from behind. Client suffered multiple fractures of her ankle, torn tendons in her elbow, requiring surgery, and traumatic carpal tunnel syndrome, requiring surgery. Liability denied – no offer. Settled for $100,000 policy limit.

D. B.: Client driving her van on a highway when another driver approaching her in the opposite direction loses control of his car due to excessive speed, slamming into client’s van. Client suffered a concussion, TMJ damage, tooth damage, wrist injuries, and spinal damage. Insurance company refused to make an offer before filing suit. Settled for $100,000 at settlement conference.

D. B.: Client rear ended while lawfully stopped. Client had two ruptured discs as a result of the wreck. Settled for $100,000 policy limits.

J. D.: Client hit by newspaper delivery driver, breaking his ankle. The newspaper company denied liability. Our investigation revealed the newspaper driver had his own insurance policy and the case settled for the $100,000 policy limits.

G. R.: Client rear ended by drunk driver. He had hip and pelvic injuries. Although no surgery was required, he was left with a permanent disability. Prior to arbitration, no money was offered by the insurance company. $100,000 policy limit ultimately recovered at arbitration.

V. D.: Client hit by a car while walking in a parking lot. Her hip was badly injured and she had total hip replacement surgery. The case against the at-fault driver settled for policy limits of $50,000. An underinsured motorist claim was brought against client’s own insurance company. The claim was denied and no money was offered. After instituting legal action, an additional $50,000 was recovered for the client.

R. R.: Client was rear ended while lawfully stopped by an uninsured driver. Client’s injuries included whiplash and a left hip injury that required surgery. At arbitration, the insurance company’s attorney recommended an award of $0. The arbiter awarded over $80,000.
